1. Acceptance of Terms

By accessing AsiaSilkRoadTours (“we” or  “ASRT”) or booking any tour or service, you agree to:

  • Comply with all laws applicable in your country of residence AND the destination countries.
  • Provide accurate personal/travel document details (passport, visa, health certificates).
Kindly ensure a thorough review of the following information prior to making a reservation.

2. Booking & Payments

2.1 Booking Confirmation 

  • Online Bookings: Confirmation is issued upon successful payment and receipt of the booking confirmation email.

  • Tailor-Made Bookings: Confirmation is provided once the deposit or full payment has been received, and a formal tour confirmation letter has been issued by our travel consultants.

2.2 Deposit Policy

  • A deposit of 10% of the total tour cost is required at the time of booking to secure your reservation.
  • Unless otherwise specified, the remaining balance is due no later than 30 days prior to the tour departure date.
  • For bookings made within 30 days of the tour’s start date, full payment is required at the time of booking.
  • Price inclusions: Accommodations (3-5★ stated in itinerary), licensed guides, listed meals, and ground transport.
  • Exclusions: Flights (unless specified), personal expenses, visas, and travel insurance.

2.2 Currency & Pricing

  • All prices in USD, subject to fuel surcharges or government tax changes.
  • Payment methods: Credit cards (Visa/Mastercard), Alipay, WeChat Pay, Bank transfers, Wire Transfers, Paypal.

3. Cancellations & Refunds

3.1 Cancellation Policy

We recognise that travel plans may change, and we are committed to assisting you through the process. Should you need to cancel your tour, please take note of the following procedure:

  • All cancellation requests must be submitted in writing via email or fax.

  • Kindly note that cancellations cannot be accepted verbally or through instant messaging platforms such as WhatsApp or WeChat.

  • Force Majeure: Full refund if cancellation due to war, natural disasters, or government travel bans. Check below for detailed clause for force majeure.

3.3 Refund Process

  • Upon approval of your cancellation request, your designated travel consultant will proceed to initiate a refund application with our finance department.
  • Refunds are typically processed within 7-15 business days.
  • Payment Methods
    • Refunds will be issued via PayPal for payments originally made through:
      • PayPal
      • Bank transfer / Wire transfer
      • WeChat Pay
      • Alipay
  • We aim to maintain a flexible approach while ensuring we can effectively plan and deliver your tour experience.

4. Traveler Responsibilities

4.1 Traveler Documentation Requirements

  1. All travelers must have:
    • A valid passport with at least 6 months validity from the return date
    • Necessary visas or permits for China
  2. It is the sole responsibility of each traveller to ensure they possess all necessary travel documents prior to departure.

  3. Passports must contain a minimum of two blank pages to accommodate visa stamps.

  4. AsiaSilkRoadTours may provide assistance with visa applications upon request; however, it cannot be held liable should a traveller fail to obtain the required documentation.

  5. Travellers are advised to verify passport and visa requirements well in advance, as processing times may extend over several weeks.
  6. It is strongly recommended to make photocopies of your passport and visa pages:
    • Carry one copy separately from the originals while travelling.

    • Leave an additional copy with a trusted contact at home.

  7. Travellers under the age of 18 must carry an original birth certificate in addition to a valid passport.
  8. Ensure that the details on your passport and visa match those on your flight tickets exactly.
  9. AsiaSilkRoadTours assumes no responsibility for travel disruptions resulting from incomplete, inaccurate, or invalid documentation.

4.2 Traveler Health Requirements

Your wellbeing is our priority. To ensure a safe and enjoyable experience, we kindly ask that you:

  1. Kindly notify us in writing of any physical, emotional, or mental health conditions that may necessitate professional care or the use of special equipment during your trip.
  2. For Guests Using a Wheelchair

    • We recommend bringing your own foldable wheelchair for convenience.

    • Please note that certain destinations and types of tours may have limited accessibility.

  3. We retain the right to refuse bookings if we determine that a participant’s health condition may pose a risk to their safety or negatively impact the experience of other travellers.

  4. Pregnancy: For the safety and well-being of all participants, we are unable to accommodate travellers who will be six months pregnant or further along at the time of travel.
  5. You responsibilities:
    • You are advised to carefully consider the potential risks associated with international travel.

    • It is your responsibility to review health and safety conditions at both your destination and any transit locations.

    • You should consult with your healthcare provider regarding any required vaccinations and necessary health precautions.

We are committed to accommodating all travellers to the best of our ability, prioritising your health and safety above all else. Should you have any concerns or inquiries regarding medical matters related to your tour, please do not hesitate to contact us.

4.3 Traveler Travel Insurance

  • ASRT strongly advises all travelers to secure comprehensive travel insurance, covering medical emergencies, trip cancellations, and loss or damage to baggage. While we do not typically offer travel insurance directly, certain tours may include specific insurance coverage, which will be explicitly outlined.
  • It is essential to note that ASRT is not liable for any accidents or incidents leading to property damage, personal injury, death, travel delays, or other unforeseen events beyond our control. Any claims arising from such circumstances will be addressed in accordance with the policies of the respective service providers, including airlines, hotels, and transportation companies.
  • Given the nature of our cancellation policy and the possibility of unexpected events during travel, we strongly recommend purchasing travel insurance for your journey. Additionally, securing appropriate travel insurance is a mandatory requirement when booking with us for travel to China. The insurance should provide coverage for potential booking cancellations and offer sufficient medical protection for illness, injury, and repatriation if necessary.
  • For your added peace of mind, ASRT tour packages include China Life Tourist Accident/Casualty Insurance, offering coverage up to $29,000 at no additional cost. This complimentary coverage is part of our commitment to ensuring your safety and security during your travels with us.

5. Limitation of Liability

Asia Silk Road Tours is not liable for:

  • Any errors, inaccuracies or failures in information provided by third parties (airlines, hotels, etc.).
  • Disruptions or changes caused by service providers or other organisations beyond our control. This includes unexpected itinerary changes, equipment issues, or actions taken by authorities.
  • Events outside our influence, such as natural disasters, political instability, disease outbreaks, or security-related incidents. In such cases, any added costs or difficulties must be managed by the traveller.
  • Problems caused by non-compliance with these rules or for any lost or stolen items due to negligence. It is each traveller’s responsibility to follow customs regulations and take care of their personal belongings.
  • Itinerary changes due to weather, political unrest, or safety concerns (alternative arrangements will be provided).
Please note:
  • To maintain service quality, we reserve the right to adjust tour details, including accommodations, transportation, or itineraries, if necessary. Should a tour be cancelled before departure, a full refund will be issued.

  • Some tours include activities that require care and personal judgement. While our staff are available to assist, participants take part at their own risk. Once we have fulfilled our responsibilities, ASRT and its team cannot be held liable for incidents that may occur.

6. Service Modifications

We recognise that travel plans may be affected by unexpected developments. Although every effort is made to deliver services exactly as confirmed, adjustments may occasionally be required due to:
  • Unanticipated events

  • Logistical or operational requirements

  • Health and safety priorities

  • External conditions outside our influence

In such circumstances:

  • You will be informed without delay regarding any required modifications.
  • Wherever feasible, appropriate substitute arrangements will be proposed.
  • Should no viable alternatives be available, a refund will be provided for the services impacted.

Important Notice Regarding Tour Modifications and Liability:

  • Kindly be advised that ASRT cannot be held responsible for any losses arising from events beyond our control (force majeure) or from changes initiated by the client.

  • Should you request modifications to your confirmed itinerary, please be aware that such changes may result in additional charges imposed by our service providers. Any costs incurred as a result of these adjustments will be the sole responsibility of the traveller.

  • While we are committed to supporting you with any requested amendments, we cannot guarantee that all changes will be possible due to availability or supplier restrictions.

  • Our commitment remains to provide a safe and enjoyable travel experience. We are dedicated to maintaining transparency regarding any potential changes that may affect your journey, whether anticipated or unforeseen.

7. Amendment of Terms

AsiaSilkRoadTours retains the authority to revise or amend these terms and conditions at its discretion and without prior notification. Travellers are encouraged to consult the most up-to-date version of the terms prior to confirming any booking.

8. Service Termination Policy

AsiaSilkRoadTours reserves the right to discontinue services to any client whose behaviour is deemed unlawful, disruptive, or inappropriate towards our staff or representatives. This includes, but is not limited to, conduct that is abusive, discriminatory, obscene, or sexually inappropriate in nature.

9. Intellectual Property

  • All content (itinerary designs, photos, maps) on the Site is owned by Asia Silk Road Tours.
  • Commercial use of content requires written permission; attribution required for social media sharing.

10. Privacy Policy

By using our website, you agree to our Privacy Policy regarding data collection, use, and protection. Please refer to our Privacy Policy page for details.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Asia Silk Road Tours is registered.

Force Majeure Clause

“Force Majeure” pertains to exceptional events or circumstances beyond the reasonable control of JustChinaTours, which hinder or prevent the fulfilment of contractual responsibilities. In such cases, the company shall not be held liable for any failure or delay in performing its obligations.

Events considered force majeure may include, but are not limited to, the following:

  • Armed conflict or threats thereof
  • Civil disturbances, uprisings, or public disorder
  • Acts of terrorism
  • Labour strikes or industrial actions
  • Natural catastrophes such as earthquakes or volcanic activity
  • Extreme weather phenomena
  • Outbreaks of fire
  • Widespread health emergencies, including pandemics or epidemics
  • Any other comparable circumstances that fall outside the direct control of AsiaSilkRoadTours

AsiaSilkRoadTours, along with its service providers, shall not be held liable for any failure to fulfil contractual obligations arising from unforeseen and unavoidable circumstances, even when all reasonable precautions have been taken. In such cases of force majeure, the company is unable to offer compensation or assume responsibility for any resulting losses or inconveniences. This clause applies in situations where external events beyond the company’s control either hinder the delivery of agreed services or result in harm or disruption to the customer.
